TERMS OF SERVICE
1. Membership and Payment Terms
Membership Types: Crush Cycle offers various membership options, including the Value Pass, Unlimited Membership, and Pay-in-Full Membership. Details of each membership are outlined on our website and at our studio.
Payment: Membership fees are due monthly or annually or in full, depending on the membership type. All payments are non-refundable, except as required by law.
Automatic Renewal: Monthly memberships will automatically renew unless a cancellation notice is provided as outlined below.
Cancellation: Members may cancel their membership by providing a 30-day written notice. The cancellation will take effect after the notice period. No refunds will be issued for any remaining time within the cancellation notice period.
2. Studio Policies
Class Reservations: Members are encouraged to reserve classes in advance. Reservations can be made online or at the studio.
Cancellation of Class Reservations: To cancel a class reservation without penalty, members must do so at least 12 hours before the scheduled class time. Late cancellations or no-shows may result in a fee. (unless noted by health or emergency situation)
Late Fee $10 (less than 12 hrs before class)
No Show Fee $15
Arrival Time: Members are advised to arrive at least 15 minutes before class starts. Late arrivals may not be admitted and could forfeit their spot. After the class begins, riders are not allowed to enter the studio.
Attire and Equipment: Proper athletic attire, including running shoes or cycling shoes are required to ride. Open toe shoes are not permitted.
Health and Safety: Members are responsible for informing the instructor of any health issues or injuries prior to the start of class. Crush Cycle is not liable for any injuries sustained during class.
3. Facility Use
Access: Only members and guests with valid passes or reservations are permitted to use Crush Cycle’s facilities.
Behavior: Members must conduct themselves in a respectful and courteous manner at all times. Disruptive behavior or damage to property may result in suspension or termination of membership.
Personal Belongings: Crush Cycle is not responsible for lost, stolen, or damaged personal belongings. Please use the provided lockers and take necessary precautions to secure your items.
4. Privacy and Data Protection
Personal Information: By joining Crush Cycle, you agree to provide accurate and up-to-date personal, contact, and payment information. We respect your privacy and will only use your information in accordance with our Privacy Policy.
Marketing Communications: Members may receive marketing communications from Crush Cycle. You can opt-out at any time by following the instructions provided in the communication.
5. Changes to Terms and Conditions
Modifications: Crush Cycle reserves the right to modify these Terms and Conditions at any time. Members will be notified of any significant changes via email or a notice posted at the studio.
Acceptance of Changes: Continued use of Crush Cycle’s services after any modifications to these Terms and Conditions constitutes acceptance of the changes.
6. Safety and Risk Acknowledgment
By participating in any classes, activities, or using any equipment at Crush Cycle, you acknowledge and accept the inherent risks associated with physical exercise and indoor cycling. We prioritize your safety and provide instructions to reduce the risk of injury; however, it is your responsibility to listen to your body, use the equipment properly, and follow the guidance of our instructors.
You agree to assume all risks related to your participation and waive any claims against Crush Cycle, its instructors, and staff for any injuries or accidents that may occur. Please consult with a healthcare professional before starting any new exercise program, especially if you have any underlying health conditions.
7. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California and the city of Seaside.

Crush Cycle Seaside Membership Terms & Conditions
Welcome to Crush Cycle Seaside! By purchasing a membership, you agree to the following terms and conditions:

1. Membership Options
Crush Cycle Seaside offers the following membership types:
Value Pass: offers access to $5 classes
Unlimited Membership: unlimited monthly access to classes
Pay-in-Full Membership: unlimited 1 year membership
Membership details, including pricing, benefits, and duration, are available on our website or by contacting the studio directly. These memberships can be discontinued or altered for future sale at any time.
Memberships Conditions
Membership Commitment: All memberships require a commitment as specified in the chosen membership plan (e.g., 3 months, 6 months etc.). By signing up, the member agrees to complete all payments for the total number of months in their selected membership plan. After fulfilling the initial term, the membership will automatically transition to a month-to-month plan. The plan continues indefinitely until the member cancels with a written 30 day notice.
Pay In Full Agreement: By securing a pay in full membership, you agree to pay the full amount listed in your package. By signing up, you agree to paying the full membership cost in one payment. This may appear in a separate invoice.
Payment: Regular payments will begin on the day you sign up and will follow the standard billing cycle thereafter, charged monthly at a minimum number of months agreed upon in the contract. You are required to provide your billing information when you sign up for a membership.
Credit Card Processing Fee: All purchases made through Crush Cycle, including memberships, class packages, and merchandise, are subject to a 3.4% credit card processing fee. By completing a purchase, you acknowledge and agree to this fee as part of the transaction cost.
No Retroactive Discounts or Promotions
All purchases, including memberships, class packages, and special offers, are final at the time of purchase. Promotional discounts or special rates offered after your purchase date cannot be applied retroactively. By completing your purchase, you acknowledge and agree to the pricing at the time of the transaction.
2. Payment and Billing
Payment Method on File: All members including those on credit package plans are required to have a valid payment method on file at all times. This is necessary for processing membership fees, class reservations, and any applicable fees such as late cancellations or no-shows. It is the member’s responsibility to ensure that the payment information is up to date.
Billing Cycle: Membership fees are billed on a recurring monthly basis, unless otherwise specified. Payments will be automatically charged to the payment method provided on the first day of each billing cycle. If you signed up on the 5th, you'll be charged every month on the 5th.
Payment Declines: If a payment method is declined or becomes invalid, the member will be notified and asked to update their payment information immediately. Failure to provide a valid payment method may result in the suspension or termination of your membership until the balance is settled.
Collections: If your account remains unpaid for more than 60 days and we are unable to contact you or arrange payment, Crush Cycle Seaside reserves the right to send the outstanding balance to a collections agency. Additional fees and charges may apply as part of the collections process, and this may impact your credit score. Any legal fees or costs incurred as part of the collections process will be your responsibility.
Additional Fees: Any additional fees such as late cancellations or no-show charges will be automatically charged to the payment method on file. Members will receive notifications when these fees are applied.
3. Cancellation Policy
Month-to-Month Memberships: You may cancel your membership at any time by providing a written 30 day notice to our email. This means you will always have 1 more billing cycle prior to cancellation. Membership continues indefinitely month-to-month until cancelled by notice. No refunds will be issued for partial months.
Pay-in-Full Memberships: Pay-in-full memberships are non-refundable and subject to late class cancellation fees. Therefore, a form of payment must be on file for this membership at all times. Early termination is not permitted unless under special circumstances approved by Crush Cycle management. There is NO FREEZE option for the pay in full membership, as this is already calculated into the cost.
Freeze Policy: Members may freeze their account for up to 2 months within a calendar year for a fee of $25/month. To request a freeze, please contact the studio. Pay In Full yearly membership is not eligible for freezes.
Early Termination for Contract-Based Memberships: If you have signed up for a membership with a specified commitment period (e.g., 6 or 12 months) and wish to cancel before the end of the commitment, an early termination fee of $125 will apply. This fee must be paid at the time of cancellation, and any remaining unused classes or benefits will be forfeited.
Late Class Cancellations: Class reservations must be canceled at least 12 hours before the scheduled start time. Cancellations made within the 12-hour window will incur a $10 late cancellation fee.
No-Shows: If you do not attend a reserved class and fail to cancel via phone or email, a $15 no-show fee will be applied.
Class Credit Cancellations: If you are using a class credit to reserve a class and cancel past the 12-hour window, the credit will remain in your account; however, you will still be subject to the $10 late cancellation fees. No-shows will also be subject to a $15 fee, but the credit will not be lost and can be used for future classes.
Cancelling Your Membership: Please provide a written minimum 30 day notice to the email info@crushcycling.com.
4. Class Reservations
Class Reservations: All members must reserve their spot in advance through our online booking system or mobile app. Walk-ins will be accepted on a space-available basis but are not guaranteed a spot.
Class Cancellations: Classes can be cancelled by calling the studio, emailing us, or cancelling through your mobile app.
Arrival Time: Members are required to arrive at least 10-15 minutes before the class begins to allow time for check-in and bike setup.
Late Arrivals: For the safety of all participants, riders who arrive after the first song has started will not be permitted to join the class.
Crush Cycle Seaside reserves the right to release your reserved spot if you do not arrive to your scheduled class time.
5. Refund Policy
No Refunds: Membership fees, drop-in class purchases, and class packages are non-refundable. Exceptions may be made under special circumstances (e.g., medical reasons), by the governing law, or at the discretion of Crush Cycle Seaside management. All refund requests must be submitted in writing and will be reviewed on a case-by-case basis.
6. Studio Etiquette & Sexual Harassment
All members are expected to treat staff, instructors, and fellow riders with respect and courtesy.
Harassment, discrimination, or disruptive behavior, including gossip, negativity, or drama, is not acceptable.
Crush Cycle reserves the right to suspend or terminate memberships due to inappropriate or disruptive behavior in the studio.
Sexual Harassment Disclosure: Crush Cycle Seaside has a zero-tolerance policy for any form of sexual harassment or inappropriate behavior. This includes unwelcome sexual advances, inappropriate comments, or physical contact towards any staff or members. Any behavior that creates an intimidating, hostile, or offensive environment will result in immediate action, which may include suspension or termination of membership.
7. Health and Safety
Members are responsible for ensuring they are physically capable of participating in cycling classes. If you have any medical conditions, please consult with a healthcare provider before joining.
By participating, members acknowledge that they do so at their own risk and release Crush Cycle Seaside from any liability for injuries or damages.
8. Membership Termination by Studio
Crush Cycle Seaside reserves the right to terminate or suspend a membership at its discretion for violations of studio policies, disruptive behavior, non-payment or anything deemed as harassment towards any staff or members. Any remaining class credits or membership fees will be forfeited in cases of termination due to harassment violations.
9. Membership Benefits
Membership benefits, including discounts, class times, schedule, events, guest passes, and early access to classes, are non-transferable and may be subject to change or removed at Crush Cycle Seaside's discretion. This does not allow for refunds or partial refunds of any kind.
10. Amendments to Terms
Crush Cycle Seaside reserves the right to modify these terms and conditions at any time. Changes will be communicated to members via email or posted on our website.

Waiver and Release of Liability
By participating in classes, activities, or events at Crush Cycle Seaside, you acknowledge and agree to the following:
1. Assumption of Risk
I, the undersigned, understand and acknowledge that participation in indoor cycling classes and other physical activities at Crush Cycle Seaside involves inherent risks, including but not limited to, physical injury, muscle strains, cardiovascular stress, breathing and other potential hazards. I voluntarily assume all risks associated with participating in these activities.
2. Health and Medical Considerations
I certify that I am physically fit, have no medical condition that would prevent my participation in cycling or other physical activities, and have consulted with a healthcare professional if necessary. I acknowledge that it is my responsibility to stop or modify my participation in any activity if I feel discomfort, pain, or fatigue, and I will immediately notify an instructor of any concerns.
3. Release of Liability
In consideration of being permitted to participate in classes and activities at Crush Cycle Seaside, I hereby release, discharge, and hold harmless Crush Cycle Seaside, its owners, employees, instructors, and agents from any and all claims, demands, actions, or causes of action related to any injury, illness, or damages that may result from my participation. This release includes but is not limited to, liability for negligence or any other form of liability arising out of my participation.
4. Equipment Use
I acknowledge that the use of indoor cycling equipment, clip-in cleats and other studio equipment carries certain risks. I agree to use all equipment as instructed by the staff and understand that improper use may lead to injury. I release Crush Cycle Seaside from any liability related to the malfunction or misuse of equipment during my participation.
5. Personal Property
I understand that Crush Cycle Seaside is not responsible for the loss, theft, or damage of personal property brought to the studio. I assume full responsibility for safeguarding my personal belongings while on studio premises.
6. Photography and Media Release
I understand that Crush Cycle Seaside regularly uses photography and video to promote and market the studio. My image may be captured during classes, events, or while using the studio's facilities and may be used in social media posts, on the website, or in other marketing materials such as newsletters, advertisements, and promotional videos.
While we love sharing the energy and community spirit of our classes, we respect your privacy. If you prefer not to be photographed or filmed, please notify the studio staff before or during class, and we will ensure your image is not used in any media. By participating in studio activities, I acknowledge and agree that unless I have notified the studio otherwise, my image may be used by Crush Cycle Seaside for promotional purposes.
7. Minor Participants
For participants under the age of 18, a parent or legal guardian must sign this waiver on their behalf. The parent or guardian assumes all risks and responsibilities for the minor’s participation in Crush Cycle Seaside activities.
8. Agreement to Terms
By signing this waiver, I acknowledge that I have read and understood its contents, including the assumption of risk and release of liability, and that I am voluntarily agreeing to these terms. I agree that this waiver will remain in effect for all future classes and activities at Crush Cycle Seaside unless revoked in writing.
